This Privacy Policy explains the types of information that Double Ro Ltd. (the "Company" or "we") collect about you, how we use that information, and when and how you can limit our use of that information. Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it.

Several states have enacted comprehensive privacy laws that provide consumers with certain rights concerning the collection and use of personal information. For example, the State of California has enacted the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (together, and as augmented by regulations, the "CCPA"). At this time, the Company does not believe that it is subject to the CCPA—or the other state privacy laws that were passed thereafter. However, the privacy and security of your information is important to us and we strive to comply with industry best practices regardless of legal requirements. To that end (but without waiving the right to assert that Double Ro is not subject to state privacy laws, as all rights are reserved), we adopt this Privacy Policy in an effort to meet the principles of the CCPA and other emerging state laws. Any terms defined in the CCPA have the same meaning when used in this Privacy Policy.

This Privacy Policy applies to people who interact with the Company in their capacities as consumers, potential consumers, or visitors ("You"). It does not apply to employees or job applicants.

This Privacy Policy applies to information collected by us: on elephantstock.com (the "Website") (including the chat feature on the Website), through offline activities ("Offline), by email, text, other electronic messages between you and this Website, SMS/MMS messages, or through the Company's social media accounts (the "Communications"), and through mobile applications that We provide and that include or link to this Privacy Policy (the "Applications"). The Website, Offline, the Communications, and the Applications, together, are the "Services."

If you do not agree with our policies and practices as set forth herein, your choice is not to use the Services. By accessing or using the Services in any manner, you agree to this Privacy Policy and you consent that we will collect, use, and disclose your information as disclosed in this Privacy Policy.

This is the Consumer Privacy Notice (the "Consumer Privacy Notice") of Double Ro Ltd. ("Double Ro," the "Company" or "us").

Scope of Notice: This Consumer Privacy Notice applies only to persons who interact with the Company in their capacities as customers, potential customers, or visitors (the "Consumers" or "you"). This Consumer Privacy Notice applies to all websites (including any chat feature on the websites), apps, social media pages, communications, and other online and offline services operated by the Company (collectively, the "Services").

What personal information does Double Ro collect and for what purposes? We collect personal information from and about our Consumers to support our business operations, including all of the purposes listed below. When we use the term "personal information," we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information does not include publicly available information from government records or de-identified or aggregated consumer information, or certain personal information protected by other sector-specific federal or state statutes.

Some types of personal information are regarded as "sensitive personal information." For example, personal information that reveals a consumer's account log-in and password is sensitive personal information. While we collect information that falls within the sensitive personal information categories listed in the table below, the CCPA does not treat this information as "sensitive" because we do not collect or use it to infer characteristics about a person.

The tables below show what categories of personal information and sensitive personal information are collected by the Company with respect to our Consumers. For each category, the tables also list our expected retention period, and whether we sell the information or share it with third parties for cross-context behavioral advertising.

Please note: we do not sell personal data sets to third parties. However, subject to your right to opt-out, we do use website cookies and engage in cross-context behavioral advertising, which the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act, and the related regulations (together, the "CCPA") regards as "sharing" and may also regard as a "sale." Additionally, please note that when you engage with a third-party (by, for example, clicking on a link that may be accessible on our Website), you should review the third party's privacy policies prior to providing your personal information to the third party. This policy does not cover information collected by companies that we neither own nor control or individuals who are not managed or employed by the Company. (However, the third party that runs the chat feature on our Website does so on our behalf and the PI collected via the chat feature on the Website is covered by this Privacy Policy.)

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes those CCPA rights. Although we do not believe that we meet the criteria that would make Double Ro subject to the CCPA, we have chosen to honor its principles for all of our customers, regardless of where they live.

 

Right to Know and Data Portability

The CCPA provides California residents with the right to request disclosure of certain information regarding our collection and use of their personal information (the "right to know").

We respect the right to know. You may request that we disclose certain information about our collection and use of your personal information (the "right to know"). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Deletion), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • sales, identifying the personal information categories that each category of recipient purchased; and
    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
  • The specific pieces of personal information we collected about you (also called a data portability request).

 

Right to Request Deletion

The CCPA provides California residents with the right to request that we delete any of their personal information that we collected and retained, subject to certain exceptions.

Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Deletion), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

 

Exercising Your Rights to Know or to Request Deletion

To exercise your rights to know or request deletion as described above, you will need to submit a verifiable consumer request. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you.

The verifiable consumer request must:

  1. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
  2. Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information (or an authorized representative), which may include:
  3. For consumers who make requests to know categories of personal information or for deletion, personal information data points that match at least two data points maintained by us.
  4. For consumers who make requests for specific pieces of personal information, personal information data points that match at least three data points maintained by us, together with a signed declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request

You can submit your verifiable consumer request through one of the following methods:

We recommend using our online form for the most efficient processing of your request. However, all methods are equally valid for submitting your verifiable consumer request.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent you must provide the authorized agent written, signed permission to make the verifiable consumer request on your behalf. Additionally, before we will provide specific pieces of personal information to an agent, you must verify your identity directly with us and confirm (directly with us) that you have given the agent permission to submit the request for specific pieces of information. Alternatively, an authorized agent may make a verifiable consumer request based upon a power of attorney pursuant to California Probate Code sections 4000 to 4465. We may deny a request from an agent if these requirements are not met.

You do not need to create an account with us to submit a request to know or delete.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please email us privacy@elephantstock.com or call 800-474-8184

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. The response we provide will explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Notice of Right to Opt-out of Sale/Sharing

If you are age 16 or older, you have the right to direct us to not sell or share your personal information at any time (the "right to opt-out"). We do not sell or share the personal information of consumers we actually know are less than 16 years old. Consumers who opt-in to personal information sales or sharing may opt-out of future sales or sharing at any time.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales or shares at any time in the Privacy Preference Center here.

 

Non-Discrimination

We will not discriminate against you for exercising any of the privacy rights described in this policy. Unless permitted by applicable law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by law that can result in different prices, rates, or quality levels. Any permitted financial incentive that we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. We are not currently offering these kind of financial incentive programs.
